Indemnité Légale de Licenciement

The indemnité légale de licenciement is the statutory dismissal indemnity to which an employee in France may be entitled under certain conditions when dismissed by their employer.

The purpose of this indemnity is to compensate the employee financially for the loss of their job. The amount of the indemnity is determined, among other factors, by the employee's length of service and reference salary.

When is the indemnité légale de licenciement payable?

An employee is generally entitled to this indemnity if:

In certain situations, such as dismissal for serious misconduct (faute grave) or gross misconduct (faute lourde), entitlement to the indemnity may be forfeited.

How is the indemnity calculated?

The calculation is based on:

  • The employee's length of service.
  • The reference salary.
  • The statutory calculation rules.

Some CCNs (Conventions Collectives Nationales) provide for a dismissal indemnity that is higher than the statutory minimum. In such cases, the employer must apply the more favourable scheme.

Why is this indemnity important for employers?

When dismissing an employee in France, employers must take into account not only the dismissal procedure but also the correct calculation of the indemnity due.

An incorrect calculation may lead to:

  • Employment law disputes.
  • Payroll corrections.
  • Damages claims.
  • Additional costs for the employer.
